1. Agreement to Terms

Welcome to cadmissions.com (the “Site”), operated by New Nectar LLC d/b/a CAD Missions (“CAD Missions,” “we,” “our,” or “us”). These Terms & Conditions (the “Terms”) constitute a legally binding agreement between you (“you” or “User”) and CAD Missions. By accessing or using the Site, purchasing our products, enrolling in our courses, or otherwise interacting with us, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Site or any services provided by CAD Missions.


2. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Site. By using the Site, you represent that you meet this requirement. If you are under 18, you may use the Site only with the consent of a parent or legal guardian.


3. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page and, if the changes are material, notify you via email or a notice on the Site. Your continued use of the Site after the effective date of any update constitutes acceptance of the revised Terms.


4. Accounts and Security

  1. Account Creation. Certain features require you to create an account. You agree to provide accurate, current, and complete information and to keep it updated.

  2. Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

  3. Notification. Notify us immediately at [email protected] of any unauthorized use of your account.


5. Products, Courses, and Services

  1. Digital Content. We offer digital workbooks, online courses, and downloadable resources (collectively, “Courses”).

  2. Physical Goods. We may sell physical products such as drafting kits or merchandise (“Products”).

  3. Availability. All Courses and Products are subject to availability and we reserve the right to discontinue or modify them at any time without notice.

  4. License. When you purchase a Course, CAD Missions grants you a limited, non-exclusive, non-transferable license for personal, non‑commercial use only.


6. Pricing & Payment

  1. Pricing. Prices are displayed in U.S. dollars unless otherwise indicated. Prices and promotions may change without notice.

  2. Payment Processing. Payments are processed by third‑party providers (e.g., Stripe®, PayPal®). We do not store full credit‑card numbers.

  3. Taxes. You are responsible for any applicable taxes.


7. Refund Policy

  • Digital Products & Courses. Refunds are available within 14 days of purchase, provided you have completed no more than 20% of the Course content. To request a refund, email [email protected] with your order details.

  • Physical Products. Returns are accepted within 30 days of delivery if items are unused and in original packaging. You are responsible for return shipping costs unless the item arrived damaged or incorrect.


8. Intellectual Property

  1. Site Content. All content on the Site—including text, graphics, videos, software, and trademarks—is owned by or licensed to CAD Missions and is protected by U.S. and international intellectual‑property laws.

  2. User License. Subject to these Terms, CAD Missions grants you a limited, revocable, non‑exclusive license to access and use the Site for personal, non‑commercial purposes.

  3. Restrictions. You may not copy, modify, reproduce, distribute, or create derivative works from Site content without prior written consent.


9. User Content

  1. Submissions. You may upload assignments, feedback, or other content (“User Content”). You retain ownership of your User Content.

  2. License to CAD Missions. By submitting User Content, you grant CAD Missions a worldwide, royalty‑free license to host, display, and use your User Content for the purpose of operating and improving the Site and Courses.

  3. Responsibility. You are solely responsible for your User Content and warrant that it does not infringe any third‑party rights.


10. Acceptable Use

You agree not to:

  • Violate any applicable law or regulation;

  • Post harmful, fraudulent, or defamatory content;

  • Interfere with the Site’s security or operation;

  • Upload viruses or malicious code;

  • Reverse‑engineer or attempt to extract the Site’s source code;

  • Use the Site to transmit unsolicited communications (“spam”).


11. Disclaimer of Warranties

The Site, Courses, and Products are provided “as is” and “as available.” CAD Missions makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non‑infringement, or course of performance. We do not guarantee that the Site will be uninterrupted, secure, or error‑free.


12. Limitation of Liability

To the fullest extent permitted by law, CAD Missions and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with your use—or inability to use—the Site, Courses, or Products.

Our total liability for any claim arising out of or relating to these Terms or the Site will not exceed the amount you paid CAD Missions in the 12 months preceding the claim.


13. Indemnification

You agree to indemnify, defend, and hold harmless CAD Missions and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your infringement of any intellectual‑property or other rights of any person or entity.


14. Termination

We may suspend or terminate your access to the Site or Courses at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to CAD Missions, other Users, or third parties. Upon termination, your right to use the Site and Courses will immediately cease.


15. Governing Law & Arbitration

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict‑of‑law principles.

15.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, Courses, or Products (collectively, “Disputes”) shall be resolved exclusively and finally by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in English and, unless the parties agree otherwise, held virtually or in Orange County, Florida. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

Waiver of Class Actions & Jury Trials. You and CAD Missions agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You and CAD Missions waive the right to a jury trial.

15.2 Small‑Claims Option

Either party may elect to pursue an individual claim in small‑claims court in Orange County, Florida, if the claim qualifies and remains in that court.


16. Miscellaneous

  1. Entire Agreement. These Terms constitute the entire agreement between you and CAD Missions regarding the Site and supersede any prior agreements.

  2. Severability. If any provision of these Terms is held invalid, the remaining provisions will remain in full force and effect.

  3. Waiver. The failure of CAD Missions to enforce any right or provision will not be deemed a waiver of such right or provision.

  4. Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may freely assign our rights under these Terms.
